The accident occurred on January 14, 1992, while plaintiff was working on a floating raft, or float stage, that was tied to a dock at the Hunts Point Sanitation Department Transfer Station in the Bronx. The City, which owned the transfer station, had contracted with defendant Anjac Enterprises, Inc. to perform structural repairs, and Anjac had subcontracted repair of the transfer station’s fender system to plaintiffs employer, third-party defendant Macro Enterprises, Inc.
