This cause comes before us on an appeal from the district court for the county of "Victoria. The action was brought by the appellee against the appellant to recover land. The facts of the case, so far as they are thought material to be noticed are these. Sutherland and Menifee sued out an attachment called in common law parlance an original attachment, against the appellees to recover the value of goods wrongfully taken and carried away from them by the appellant.
