Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered January 31, 2003, which resentenced defendant following his conviction of the crime of criminal use of a firearm in the first degree.

Based on an incident that occurred in July 1998, defendant pleaded guilty to attempted murder in the second degree, three counts of robbery in the first degree, two counts of criminal possession of a weapon in the third degree and criminal use of a firearm in the first degree.
