ALSCHULER, Circuit Judge.

The receiver appeals from an order of the District Court allowing appellee a preferred claim against the assets of the Peoples National Bank & Trust Company of Sullivan, Ind., which, until the closing of its doors on June 27, 1932, was doing a general banking business under the National Bank Act.

The court made findings of fact to the effect that on May 27, 1932, the Peoples Bank gave appellee, a broker with principal office at Indianapolis, an order for certain Indiana road bonds, whereupon appellee confirmed the order by mailing to the Peoples Bank an invoice of the…
