Defendant, Dennis Edwards, was charged with the first degree murder of Ada Allen. Defendant’s first trial ended when the trial court declared a mistrial without prejudice based on a discovery violation committed by defense counsel. The trial court subsequently denied defendant’s motion to dismiss the charges against him based upon principles of double jeopardy.
