Justice ROBINSON for the Court.

The respondent, Toni J. Williams, appeals from a Family Court order awarding physical placement of the parties’ minor child, Dakota, to the petitioner, Fred A. Parker.

On appeal, Ms. Williams argues that the hearing justice erred in exercising jurisdiction because he failed to first make a finding that a change in circumstances had taken place subsequent to the time when the parties reached an agreement regarding custody.
