Appellee, Roberts, sued the appellant, the Missouria Glass Company, for a balance claimed to be due him as commissions on sales made by him of certain goods belonging to the appellant. He alleged that on May 9, 1907, he and appellant entered into a contract in writing, whereby he agreed to sell goods for appellant for the period of one year, and the latter agreed to pay him as compensation for his services a commission of 12% per cent, on all sales made by. him and accepted by both appellant and the purchaser, and a commission of 5 per cent, on sales of close outs, job lots, etc., at special…
