Case Summary and Issues

Alan Massey shot and killed his girlfriend after she told him that she wanted to end their relationship and that he needed to move out of their residence. The State charged Massey with murder. At trial, Massey argued that he was emotionally devastated when his girlfriend told him that their relationship was over and shot her under sudden heat. Massey asked for and the trial court gave the jury an instruction on voluntary manslaughter. The jury found Massey guilty of murder.
