Reversing.

As the issues of this equitable action are presented to this ¡court by the appeal, it appears that there is in controversy a tract of land containing approximately 166 acres. Appellant, Jacob Howard, Sr., claims title to-it under a 3,000 acre grant surveyed for William S. Howard March 6, 1845, and patented to him July 6,1846. The appellees, Idress Watkins, and others, claim the title to the same land under a 3,000 acre grant surveyed November 2, 1795, for Richard Noel and patented to Joseph Craig, assignee, on May 27, 1797.
