When the plaintiff first entered the employ of the defendant he was set to work splitting wood, and he continued at that work up to the day of the accident, a period of two weeks. One Volin, called by the plaintiff, testified that he, Volin, had been working nearly ten years for the defendant; that on the day of the accident he was ordered by one McDermott to plane some boards upon the planing machine; that he .needed some one to help him, and that McDermott in reply to his request for help told him to get the plaintiff; and that he did so.
