This is a suit in trespass to try title brought by plaintiff in error, the Houston Oil Company of Texas, against N. B. Howard, the defendant in error, on November 13, 1911. The latter, among other defenses, pleaded the statute of 5-year limitation. The trial was had on special issues, and upon the 'verdict of the jury on such special issues the trial court rendered judgment for the defendant in error.
