Affirming.

The appellee and plaintiff below, Charles Childers, was 57 years of age at the time of the filing of this action in the Bell circuit court on June 17, 1938, against the appellant and defendant below, Southern Mining Company. Defendant is a corporation and operates a coal mining plant in Bell county.
