*539In an action to recover damages for medical malpractice, the defendant Richard Rubenstein appeals from an order of the Supreme Court, Suffolk County (Tanenbaum, J.), dated November 3, 2004, which denied his motion for summary judgment dismissing the complaint insofar as asserted against him.
Ordered that the order is affirmed, with costs.
