BROTHERTON, Justice:

On August 22, 1990, the Circuit Court of Boone County reversed a decision of the Commissioner of the Division of Motor Vehicles revoking Meredith M. Breedlove’s license to drive in West Virginia for a period of ten years. Mr. Breedlove had been arrested for second-offense driving under the influence of alcohol. On appeal, the appellant, the Commissioner of the Division of Motor Vehicles, claims that the circuit court erred in reversing the revocation of Mr. Breedlove’s license.
