VOGEL, Judge.

This is an appeal from a judgment in favor of the defendant after a jury trial. The matter presently before the court, submitted on briefs without oral argument, is a motion to dismiss the appeal for failure to comply with the statutes (Secs. 28-18-06 and 28-18-09, N.D.C.C.) and rules formerly in effect, as well as Rule 11, North Dakota Rules of Appellate Procedure, effective March 1, 1973.
