The three actions entitled above duly and regularly came on for consolidated trial before the Court, sitting without a jury, on July 8, 1964, at Carson City, Nevada, of the following severable issue, to wit: Was Paul Lawrence Sweeney, at the time and place of the collision alleged in the Complaints, an employee of defendant United States of America within the scope and meaning of the Federal Tort Claims Act?
