This is an appeal from an order of the Special Term that grants a peremptory writ of mandamus to the collector of assessments and arrears of the city of New York “to vacate and set aside the record of the transfer of tax lien No. 2219, *745and to cause the taxes for the years 1903 to 1908, inclusive, against lot 24, section 5, block 1330, on the assessment map of the borough of Brooklyn, and the assessment for the opening and acquisition of New York avenue against said lot to be apportioned so that the fair and just proportion thereof chargeable against the land of” the relator…
