OPINION
EDWARD WEINFELD, District Judge.
Plaintiff brings this action under 42 U.S.C., section 1983, for a declaratory judgment and an injunction based upon her non-appointment to the position of policewoman with the New York City Police Department. She alleges that the defendants’ refusal to appoint her was arbitrary and irrational in violation of the due process clause of the Fourteenth Amendment, discriminatory in violation of the equal protection clause of the Fourteenth Amendment, and an invasion of her right to privacy and freedom of association in violation of the First Amendment.
