The plaintiff in error, hereinafter called defendant, was convicted in the district court of Pittsburg county on a charge of driving an automobile while intoxicated and sentenced to pay a fine of $500, and to serve a term of one year in the state penitentiary.
The offense is charged to have been committed on the 1st day of September, 1923. The evidence discloses that on that day defendant, with Emmett Sharp, A. S.
