MEMORANDUM DECISION

This is a consolidated appeal involving two cases originating in the Third District Court. The first appeal (Case No. 890334-CA) is from the dismissal of a petition for adoption of the minor child, J.J. The petition, filed by Fred and Linda Bullock, J.J.’s foster parents, was dismissed based on the refusal of the Division of Family Services (DFS) to consent to the adoption. The district court found the adoption petition did not invoke its jurisdiction because DFS refused to consent to the adoption.
