Error from Marion District Court. At the April Term, 1881, of the district court, plaintiff Dudley had judgment against the defendant School District No. 78, in Marion county, which brings the case here. The facts appear in the opinion.

Defendant in error (plaintiff below) commenced his action before a justice of the peace to recover on a school warrant issued by defendant. The bill of particulars simply set out a copy of the warrant, alleged its execution by the defendant, and an assignment to the plaintiff. The case was appealed to the district court, and there tried by the *161court without a jury. Findings of fact and conclusions of law were made. Thereupon the court gave leave to the plaintiff to amend his bill of particulars, which was done, and judgment entered in favor…
