The facts appear in a master’s report which has been confirmed. In 1927, while the fishing schooner *667Olivia Brown was being built in a shipyard at Essex in this Commonwealth, the plaintiff, then an alien, bought from the builder for $3,000 a one-sixteenth interest in the vessel. Her tonnage does not appear, but from the fact that she was subsequently enrolled we infer that it was twenty tons or upwards. U. S. C. Title 46, §§ 251, 273.
