Action upon two promissory notes alleged ;to have been made by the appellee to Theodore Brumbaugh, who had endorsed them to another, who had endorsed them •to the appellant, the plaintiff in the action.

The appellee answered by five special pleas, and also filed :a counter-claim, upon which he prayed a cancellation of the *71notes. Separate demurrers to each plea and to the counteiv claim, for want of facts, were overruled, and exceptions taken to the rulings. Issue was joined and a trial had in the Jay Circuit Court, where the action was commenced, resulting in n. verdict for the defendant. This…
