This is a bill in equity against the receiver of a national bank to recover the amount of a fund alleged to have been given to and held in trust by the bank under the following state of facts about which there is substantially no dispute:

In 1918 the Kennebec Trust Company of Waterville, Me., received $5,000 to be used for the benefit of the plaintiff Mildred V. Taylor, then unmarried and named Mildred V. Mitchell. A written instrument was drawn up entitled “declaration of trust,” signed and sealed by the parties, being Mrs. Taylor, called therein the beneficiary, and…
