The appellee, hereinafter called the plaintiff, brought this action against the appéllant, hereinafter called defendant, to enforce specific performance of a contract for the sale of certain land.

On October 10, 1922, the plaintiff, as the owner of said land, entered into a contract with the defendant, vendee, by which he agreed to sell and the defendant agreed to buy the lands in question, at and for a certain specified sum.
