Memorandum Decision

GOETTEL, District Judge.

In a thirteen-count complaint, plaintiff Frank Violissi challenges the City of Middle-*94town’s failure to promote him to police lieutenant due to alleged irregularities in the examination process. Plaintiff invokes this Court’s jurisdiction pursuant to. 28 U.S.C. § 1331, based upon his claim under 42 U.S.C. § 1983.
