Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Albany County), to review a determination of respondent concerning petitioner’s request for a rate increase.

Petitioner is a water-works corporation located in Suffolk County and is regulated as a public utility by respondent. From 1981 to at least June 1987, petitioner was engaged in providing meter pit installation services to its customers. No tariff was ever filed relating to these services.
