This suit was brought by H. C. Cummins, hereinafter styled plaintiff, to recover damages for permanent injury to his land and for loss of crops, against Walker D. Hines, Director General of Bail-roads of the United States, Port Worth & Bio Grande Bailway Company and) Gulf, Colorado & Santa Fe Railway Compand, hereinafter styled defendants.
