On February 3, 1961, the plaintiff, Chas. A. Kaufman Co., Limited, owner and operator of a department store in New Orleans, filed suit seeking to recover from the defendant, Julian O. Gregory, the sum of $75,000.00 representing the amount of funds which it alleged defendant had wrongfully appropriated to himself out of the cash receipts of plaintiff’s Dryades Street store during the period from June 1, 1959 through January 21, 1961 while defendant was employed as its comptroller.
