This appeal is from the decision of the Commissioner of Patents awarding priority to appellee, Peiler, for an invention relating to a method of and apparatus for delivering molten glass from a furnace to a mold. The issue is in the following two counts:

“1. The method of delivering glass from a furnace to a mold, which consists in flowing glass on a support which contacts with only a portion of the batch and subjecting the free unsupported remaining portion of the batch to heat.
