State v. Poirier
Supreme Judicial Court of Maine
1Opinion of the Court
WATHEN, Chief Justice.
[¶ 1] Defendant, Roger Poirier, appeals from a judgment entered in the Superior Court (Oxford County, Mills, J.) on a jury verdict finding him guilty of operating under the influence of intoxicants, in violation of 29-A M.R.SA. § 2411 (1996). Defendant argues on appeal that the breath sample admitted in evidence against him was not properly authenticated and that the testimony of the state’s chemist concerning the analytical test results of that sample should have been excluded on the basis of the best evidence rule. Finding no error, we affirm the judgment.
