DOYLE, Judge.

Plaintiff in error, W. H. Brown, was tried and convicted in the county court of Pottawatomie county of the crime of selling and furnishing intoxicating liquors. On June 1, 1908, he was sentenced to be confined in the county jail for a period of 40 days and to pay a fine of $100 and costs, and stand committed to jail until said fine and costs are paid. On January 26, 1909, there was filed in this court his petition in error with case-made attached. On behalf of the state a motion was filed to dismiss said appeal, which motion is as follows:
