The defendant, Fred Cherry, was found guilty by a jury of the murder of his estranged wife and was sentenced to a term of imprisonment of 20 years. On appeal, he contends that the court erred (1) in admitting evidence of the declarations of his four-year-old daughter, Michelle Cherry; (2) in admitting evidence of a pending divorce between defendant and the victim; (3) in sustaining the prosecutor’s objection to portions of defendant’s closing argument; and (4) in refusing to instruct the jury that the minor child had been declared…
