ALDRICH, Circuit Judge.

In several national publications in June 1957 the defendant-appellee, the Federal Housing Administration, advertised for sale a garden-type apartment project called Gateway Apartments located in Springfield, Massachusetts. The so-called “Prospectus and Request for Offers” contained information as to the number of units and garages, rental rates, percentage of apartment occupancy, and expenses.
