Joseph Azar challenges the district court’s refusal to quash a subpoena that it had directed at Azar’s bank, the Union Bank of Florida. The district court issued the subpoena pursuant to 28 U.S.C. § 1782(a) (1982) 1 , in response to a request by the Attorney General and Minister of Legal Affairs in Trinidad and Tobago (“Minister of Legal Affairs”). This appeal presents an issue of first impression— whether section 1782 requires that a proceeding be pending before a federal court may grant judicial assistance to a foreign official.
