On April 13, 1983, plaintiff, Mildred Clarkson Mestjian, filed suit in the circuit court of Piatt County against defendant, the town of Cerro Gordo, seeking a declaratory judgment authorizing “the disinterment of the remains of her father [Gus Clarkson from defendant’s township cemetery] and for the reburial of [the remains] beside his widow in the State of Florida.” The complaint sought, as an alternative remedy, injunctive relief to prevent defendant from interfering with or refusing to permit the disinterment.
