OPINION GRANTING JUDGMENT TO PLAINTIFF
HORTON, District Judge.
The Equal Employment Opportunity Commission (the Commission) filed this lawsuit against St. Joe Container Company 1 (St. Joe) charging that St. Joe discharged one of its employees, an employee with eight and one-half years seniority, Sylvester Hudson, for exercising rights secured to him by the civil rights laws of the United States. The Commission also charged that the reason offered by St. Joe in justification for the discharge of Hudson is pretextual.
