This is an appeal from a judgment for the sum of $4,250, in favor of ap-pellee, administratrix, as damages, resulting from the death of F. G. Welshimer, her husband, against the appellants, the Pecos & Northern Texas Railway Company and the Southern Kansas Railway Company of Texas. The trial court submitted two of the grounds upon which appellee relied for the right of recovery: (1) That the deceased, F. G. Welshimer, fell from a brake step and was caused to fall therefrom because of the wet, undried, and slippery paint thereon, and that the paint thereon at the time was wet, undry, and…
