Ansel L. Lumbert, at the time of his death on March 14, 1929, was indebted to the plaintiff bank as the maker of three promissory notes, aggregating the principal sum of $25,000.00. His widow, Hazel H. Lumbert, was appointed executrix of his will by the Probate Court on April 16, 1929. Suit was brought by the plaintiff against the defendant as executrix on April 10, 1930, and within the statutory period of limitations. R. S., Chap. 101, Sec. 15.
In the writ, the plaintiff alleged compliance with the requirements of Sec. 14 of the same Chapter, which provides that,
