This suit was instituted by the appellant, as the surviving wife of Pablo Ochoa, against appellee, railway company, to recover for the death of her husband, who is alleged to have ben killed through the negligence' of the defendant, railway company, and its employees, about the 17th day of February, 192G, while working as a section hand on the railroad’s right of way in Wichita county.
