Defendant, Lawrence Waters, was charged in the district court of Tulsa county with the crime of murder; was tried, convicted, and given the death penalty. From this judgment and sentence, he has appealed to this court.

When this case was assigned for oral argument, counsel who now represents this defendant and who filed the brief herein, but who did not represent him at the trial in the lower court, appeared and orally argued the same.
