In this proceeding pursuant to CPLR 5239 against the assignee of a judgment creditor to vacate an execution .upon the judgment and to void a levy, under the execution, upon real property owned by petitioner Alice Bottenus, the assignee appeals from a judgment of the Supreme Court, Nassau County, dated November 30, 1972, which, after a hearing, granted the application. Judgment dated November 30, 1972 reversed, on the law and the facts, with costs, and proceeding dismissed on the merits.
