YEGAN, J.

In consolidated cases, the People appeal from the orders of the Santa Barbara Superior Court granting Efrain Avina Samano’s and Juan Jose Castro-Gaxiola’s petitions for writs of habeas corpus.1 They sought release from custody pursuant to Penal Code section 859b on their own recognizance after the preliminary hearing was continued.2 The People contend that the superior court erred in ruling that section 1050.1 was inapplicable to preliminary hearings and that section 859b mandated their release on respondents’ own recognizance.3 As we shall explain, the People’s contention is…
