EDELSTEIN, District Judge.

This petition for review of an order of the Referee in Bankruptcy presents the question whether the Trustee in Bankruptcy may contract, with a party who is not a creditor of the bankrupt, to sell the right of access to the bankrupt’s books, records and files in consideration for a promise to pay to the Bankrupt’s estate a percentage of any sum that the non-creditor may recover as plaintiff in a law suit pending in West Germany.
