- dissenting. — This opinion was prepared- as the opinion of the court, but upon further consideration of the case a different conclusion was reached by a majority of the court, whereupon an opinion was prepared by another member of the court.

The bill of complaint alleges in substance that the complainant, Mildred P. Shoemaker, and the defendants, Arthur M. Powers and Irma M.
