This was a suit by appellees against appellants based on three promissory notes. The first plea of general issue having been withdrawn, it left only the plea of tender as of $66.66 and costs, Feb. 27, 1885. The third plea was a plea of partial failure and usury. The basis of the suit was the notes mentioned. First, dated June 22, 1872, due in one year, for $241.67, with interest at the rate of ten per cent, per annum, payable to James S. Martin.
