Arizona Supreme Court

LOCKWOOD, J.,

Dissenting. — I agree with the opinion of the majority of the court so far as the judg ment in favor of W. T. Bartol is concerned, and think it should be affirmed, but I regret that I cannot concur with its conclusions in regard to that portion of the judgment in favor of the Arizona Sash, Door and Glass Company.

Since the reasons given by the majority of the court involve, in my opinion, a repudiation of the construction of the lien statute made by us in American Coarse Gold Corp. v. Young, 46 Ariz. 511, 52 Pac. (2d) 1181, I shall state briefly the grounds of my dissent.
