—Appeal from an order of the County Court of Rensselaer County, entered January 29, 1979, which denied a motion for permission to serve an amended answer. The adult respondents are the owners of a dwelling in the City of Troy. Appellant maintains a combination storm and sanitary sewer system beneath the public street adjacent to this dwelling. The first three causes of action alleged in the complaint seek to recover for damages to the building and its contents, while the fourth and fifth causes of action are to *661recover for personal injuries and medical expenses as a result of injuries…
