Plaintiff Louis Morgan Vince brings this action against the Secretary of the Navy seeking judicial review under the Administrative Procedure Act, 5 U.S.C. § 706(2)(A), claiming that the actions of the Board for Correction of Naval Records (“the Board”) in denying his petition to upgrade the characterization of his discharge from the United States Marine Corps Reserves were arbitrary and capricious.
