This is a suit brought by the-Galveston & Western Railway Company to enjoin the city of Galveston and its governing body from interfering with the laying of track to form a connection between its track on Ninth street and its track on Avenue N north of the sea wall and its right of way in the city of Galveston. This is the third appeal in this case. On the-day of November, 1910, said railway company appealed from an order of the trial court refusing a temporary injunction.
